STATK OP MISSISSIPPI HANCOCK COUNTY
This agreement made and entered into by anti between the LOUISVILLE AND NASHVILLJ5 RAILROAD COMPANY, party of the first part, acting by CliAKLES MARSHALL, its Superintendent, and the CITY OF BAY ST. LOUIS, noting by its JJnyor, under a resolution of its regularly constituted municipal board,
YflTMKSSKTH: that the said party of the firBt part has authorized and empowered the Baid CITY OF BAY ST. LOUIG to open and grade a roadway across the depot grounds and right-of-way of said party of the first part on the line of Bookter Street extended, with the right to maintain same upon the conditions and subject to the provisions and stipulations hereinafter made and entered into, that is to say the (Said roadway across the premises of the said party of the first part may be used by persons or vehicles traveling on said above named street, but is not to be used by horses or live stock running at large and not harnessed or bridled, and iB not to be considered a public way or subject to use by the publio further than in this agreement stipulated. The said way is to be graded and the railroad crossing made and kept in repair by the authorities of the City of Bay St. Louis and the said LOUISVILLTC AND NASHVILLE RAILROAD COMPANY is not to be in any way responsible to the said City or to persons using said, way for the condition of said way or crossing. And the said LOUISVILLE AND NASHVILLE RAILROAD COMPANY shall not be in any way responsible to said City or to persons using said way, for any obstruction by its trains.
This license is revocable at the will of the said Railroad Company and the said City of Boy St. Louis, for its part, agrees to take, open and maintain and use, and authorize its citizens to use the said license above given, upon the conditions therein imposed, and to cease such user under thiB agreement whenever thereto required as provided and stipulated.
In testimony whereof the Baid LOUISVILLE AND NASHVILLE RAILROAD COiilPANY hath caused these presents to be signed by CHARLES MARSHALL, its Superintendent, and the said CITY OF BAY ST. LOUIS hath caused these presents to be signed by AUGUST KELLER, its Mayor, this 4th day of May, 1889.
